About the Ashley Wage Case...


Brodie & Rubinsky represents current and former employees of the Ashley Furniture manufacturing plant in Leesport, PA as Plaintiffs in the wage case.


Plaintiffs allege that Ashley Furniture has not paid its hourly non-supervisory workers in its Leesport, PA manufacturing plant for all hours worked, and for overtime when due.


Specifically, Plaintiffs claim that Ashley did not pay for all time worked at the beginning of the day, at the end of the day, and when employees worked though all or part of their breaks, and that incentive employees were not always paid correctly.


Plaintiffs seek money damages for back wages, interest, and liquidated damages based on their claims. Plaintiffs also seek future correction of pay practices, and payment by defendants of attorneys’ fees and costs.

Timeline of Events...


  • On September 17, 2010, Plaintiffs Jesus Hernandez, Steve Wambold, and Raquel Marte filed suit on behalf of themselves and similarly situated workers against Ashley Furniture Industries, Inc., Joseph Murphy, and other managers, in the Berks County Court of Common Pleas.

  • On October 15, 2010, Defendants moved the action to the United States District Court.

  • On May 22, 2013, the Court denied class certification.

Because of the Court's denial of class certification, if you have wage claims against Ashley that you want to pursue, you will need to do so individually, or as part of a consolidated lawsuit with other current and former employees.
